How Fide Forensic Foundation collects, uses, stores, and protects your information.

Fide Forensic Foundation ("the Foundation") is a Section 8 non-profit registered in India, operating from Hyderabad, Telangana. This policy explains what information we collect through fideforensic.org ("the Website") and other official channels, how we use it, and how we protect it.

The Foundation is a Data Fiduciary under the Digital Personal Data Protection Act, 2023 ("DPDP Act"). The person whose data is processed is the Data Principal. By submitting a case, contacting us, or using the Website, you consent to the practices described here. You may withdraw consent at any time by writing to contact@fideforensic.org. Upon withdrawal, the Foundation will stop processing your data within a reasonable time, except where continued processing is required by law or a court order.

1. What We Collect

When you submit a case or contact us, we may collect your name and designation, phone number and email, location and court jurisdiction, case details including FIR number, case number, stage of proceedings, and hearing dates, documents you upload including FSL reports, chargesheets, and court orders, and any other information you provide for forensic review. We collect only what is necessary for the purpose stated at the time of collection, in accordance with Section 4 of the DPDP Act.

2. How We Use It

We use your information to assess whether forensic review is warranted, assign a reviewing scientist from our panel, communicate with you or your counsel, prepare and deliver review reports, cross-examination briefs, judicial summaries, and related documents, manage cases forwarded through legal aid bodies, and comply with court orders or legal obligations.

We do not use your information for marketing, advertising, profiling, tracking, or behavioural monitoring. We do not use it for any purpose unrelated to your matter.

3. Consent and Lawful Processing

The Foundation processes your personal data on the basis of your consent under Section 6 of the DPDP Act, which must be free, specific, informed, and unambiguous. Where data is processed in connection with a legal proceeding or a court order, processing may also be carried out as a legitimate use under Section 7 of the DPDP Act.

4. Confidentiality

Every case submission is treated as a confidential professional engagement. Your information and case documents are not disclosed to any third party, including the prosecution, law enforcement, or any party to the proceedings, unless required by a court order addressed to the Foundation, required under applicable law, or expressly authorised by you.

Panel scientists and staff assigned to your matter are bound by confidentiality obligations and access only the information necessary for their role. Agreements with panel scientists include provisions mandating reasonable security safeguards in accordance with the DPDP Act and Rules.

5. Who We Share Information With

We do not sell, rent, or share your information for commercial purposes. Information may be shared with the panel scientist assigned to your case, with legal aid bodies where the case is forwarded through those channels, and with the Foundation's administrative and legal support partners under confidentiality arrangements. Sharing is limited to what is necessary for the stated purpose.

6. Security

Case documents are stored on secure servers with access limited to the reviewing scientist and staff directly involved in your matter. The Foundation maintains reasonable security safeguards including encryption, access controls, access logging, and data backups against unauthorised access, alteration, disclosure, or destruction of your information. These measures are in accordance with Section 8 of the DPDP Act, the Digital Personal Data Protection Rules, 2025, the Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

7. Data Breach Notification

In the event of a personal data breach, the Foundation will notify the Data Protection Board of India and the affected Data Principal without unreasonable delay, followed by a detailed report within 72 hours, in accordance with the DPDP Act and Rules.

8. Cookies

The Website does not use advertising networks, tracking pixels, or behavioural analytics. Functional cookies may be used for form submission and basic site operation. No personally identifiable information is collected through cookies.

9. External Links

The Website links to external resources including Indian Kanoon, LiveLaw, and other reference sources. We are not responsible for the privacy practices of those websites.

10. How Long We Keep Your Information

We retain your information and case documents for five years from the date of the last communication on the matter, after which they are securely erased. In accordance with Section 8(7) of the DPDP Act, the Foundation will erase personal data when the purpose for which it was collected has been fulfilled and retention is no longer necessary, unless retention is required by law or court order. You may request earlier erasure by writing to contact@fideforensic.org.

11. Your Rights as Data Principal

Under the DPDP Act, you have the right to access information about the processing of your personal data (Section 11), request correction of inaccurate or incomplete data and erasure of data no longer necessary for the stated purpose (Section 12), file a grievance with the Foundation or with the Data Protection Board of India (Section 13), and nominate a person to exercise your rights in the event of your death or incapacity (Section 14). 12. Children's Data

Where the Foundation processes personal data relating to a minor (a person under 18 years of age) in connection with a POCSO or juvenile justice matter, the Foundation will obtain verifiable consent from the parent or legal guardian of the minor, in accordance with Section 9 of the DPDP Act. The Foundation does not engage in tracking, behavioural monitoring, or targeted advertising directed at minors.

13. Cross-Border Data

The Foundation processes and stores all personal data within India. In the event that personal data is required to be transferred outside India, such transfer will be made only to countries or territories permitted under Section 16 of the DPDP Act, and subject to any conditions the Central Government may notify.

14. Changes to This Policy

We may update this policy at any time. The revised version will be posted on this page with a new effective date. Material changes will be noted prominently on the Website.

The terms governing access to and use of fideforensic.org and the Foundation's services.

Fide Forensic Foundation ("the Foundation") is a Section 8 non-profit registered in India, operating from Hyderabad, Telangana. These Terms govern your access to and use of fideforensic.org ("the Website") and all services provided by the Foundation through the Website, WhatsApp, email, or any other official channel.

By accessing the Website, submitting a case, or engaging the Foundation's services, you agree to be bound by these Terms. These Terms are to be read together with the Foundation's Privacy Policy, which governs the collection and processing of personal data in accordance with the Digital Personal Data Protection Act, 2023.

1. Not Legal Advice

Nothing on this Website, and nothing communicated by the Foundation through any channel, constitutes legal advice, legal opinion, or legal representation. The Foundation is not a law firm. It does not hold a licence to practise law in India or any other jurisdiction.

All review reports, cross-examination briefs, judicial summaries, and other deliverables produced by the Foundation are scientific documents authored by forensic scientists. Their admissibility, use, and evidentiary weight before any court is a matter for the court and the instructing counsel, not for the Foundation. Users should obtain independent legal advice from a qualified advocate on all legal questions arising from their matter.

2. No Outcome Guarantee

The Foundation does not guarantee any outcome in any proceeding. Forensic review identifies scientific and technical deficiencies in FSL reports. Whether a court accepts, relies upon, or gives weight to those findings is entirely a matter for the court. The Foundation accepts no responsibility for judicial outcomes.

3. Nature and Scope of Services

The Foundation provides independent forensic review services in Indian criminal proceedings through empanelled senior forensic scientists, qualified as experts under Section 45 of the Bharatiya Sakshya Adhiniyam, 2023. Submitting a case constitutes a request for preliminary assessment only. It does not create a binding engagement, guarantee acceptance, or establish any professional relationship before the Foundation's written confirmation of acceptance.

Upon acceptance, the scope of engagement, deliverables, timelines, and where relevant fee arrangements are confirmed in writing to the instructing counsel or the referring authority.

4. User Eligibility and Conduct

By submitting case materials, you represent that you are the lawful holder or authorised representative entitled to share such materials, that sharing does not violate any court order or applicable law, that the information provided is accurate and complete, and that you are not submitting materials for any purpose other than forensic review. Misrepresentation or submission of fabricated documents is a material breach of these Terms.

In accordance with Section 15 of the Digital Personal Data Protection Act, 2023, you must not impersonate another person or suppress material information while providing personal data to the Foundation.

5. Turnaround and Timelines

Indicative timelines are provided to instructing counsel at the time of acceptance. The standard turnaround is 21 days from receipt of case documents or the next hearing date, whichever is earlier. Timelines may be affected by case complexity, expert availability, delays in receipt of materials, or circumstances beyond the Foundation's control. Indicative timelines are provided in good faith and do not constitute a binding commitment.

6. Fees and Legal Aid

Privately Retained Matters: An indicative fee schedule is provided on enquiry, based on nature of service, forensic discipline, complexity, and whether expert witness appearance is required. Fees are confirmed in writing before commencement.

Legal Aid Matters: Services are available at no cost to the beneficiary for individuals represented by panel advocates or LADCs under legal aid bodies, persons meeting Section 12 eligibility criteria, and persons referred through empanelled legal aid organisations. The cost of legal aid matters is borne by the referring legal aid body or the Foundation's own resources. There is no reduction in scope, scientific rigour, or quality for legal aid matters.

7. Confidentiality and Data Protection

All case submissions are received as confidential professional engagements. The Foundation does not disclose case information to any third party except where required by a court order, applicable law, or your express written authorisation. The Foundation's collection, use, storage, and protection of personal data is governed by its Privacy Policy, which complies with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.

8. Intellectual Property

All Website content, including text, service descriptions, page structure, cross-examination frameworks, and resource library curation, is the intellectual property of Fide Forensic Foundation, protected under the Copyright Act, 1957. No content may be reproduced without prior written permission.

9. Termination

Either party may terminate an engagement by written notice. If the Foundation terminates an engagement due to a conflict of interest, expert unavailability, or any other reason, it will notify the instructing counsel promptly and return all case documents. No fee is payable for work not delivered. The Foundation may refuse or terminate an engagement at its discretion without assigning a reason.

10. Limitation of Liability

The Foundation's liability is limited to the direct consequences of a proven failure to deliver the specific services confirmed in writing for that matter. The Foundation excludes liability for the outcome of any criminal proceeding, any judicial finding regarding admissibility or weight, and consequences arising from third-party actions. Nothing in these Terms excludes liability for fraud, wilful default, or any other liability that cannot be excluded under applicable Indian law.

11. Force Majeure

The Foundation is not liable for delays or failure to perform where caused by circumstances beyond its reasonable control, including illness or unavailability of the reviewing scientist, court closures, natural disasters, government restrictions, or disruption to communication infrastructure. The Foundation will notify the instructing counsel of any such delay and resume performance as soon as reasonably possible.

12. Disclaimer of Warranties

The Website and its content are provided on an "as is" and "as available" basis. The Foundation makes no representation or warranty regarding accuracy, completeness, or fitness for purpose of any content published on the Website.

13. Third-Party Links

The Foundation does not endorse or accept responsibility for the content or privacy practices of any third-party website linked from the Website.

14. Amendments

The Foundation may amend these Terms at any time. The revised version will be posted on this page with a new effective date. Material changes will be noted prominently on the Website.

15. Severability
